Kirsten Simon Coaching, LLC (“Company”, “I”, “we” or “us”) is dedicated to respecting the privacy of your personal information, and this privacy notice (“Privacy Notice”) describes what information is collected from you on our website, KirstenSimonCoaching.com, mobile versions and related services (hereinafter the “Site”) and your choices about the collection and use of your information when you subscribe to/ purchase our services for personal coaching, subscribe to our newsletter, interact with us, participate in our surveys, online advertisements or marketing emails, or engage with any other websites, pages, features, or content we own, operate and/or provide (collectively with the Site, the “Services”).The term “you” refers to anyone who views, uses, and/or visits the Site.

By visiting and using the Site in any manner, you accept and agree to be bound by this Privacy Notice, including without limitation the collection and use of your Personal Information, as defined below.  If you do not accept this Privacy Notice or do not meet or comply with the provisions set forth herein, then you shall not use the Site.  If required by applicable law, we will seek your express consent to process personal data (i) provided by you and/or (ii) collected during your use of the Site.  Any consent shall be entirely voluntary.  You must not access or use the Site if you do not wish to be bound by this Privacy Notice. 

CHILDREN’S PRIVACY

We respect the privacy of children and “child” means an individual under the age of thirteen (13). All information and content provided through the Site is intended for individuals over the age of eighteen (18) that reside in the United States. By using the Site, you represent that you are at least eighteen (18) years old and understand that you must be at least eighteen (18) years old in order to use the Site. We do not knowingly collect, use or disclose personal information from children under the age of thirteen (13) without prior parental or guardian consent. If you believe personal information is collected from someone under the age of thirteen (13) without parental or guardian consent, then please contact us to have that information deleted at hello@kirstensimoncoaching.com.

WHAT INFORMATION WE COLLECT AND HOW IT IS USED

Personal Information You Choose to Provide

“Personal Information” means data that allows someone to identify or contact you, including, for example, your name, address, telephone number, email address, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. When you access the Site, you may provide certain personally identifiable information that you knowingly choose to provide, which is collected on an individual basis, including but not limited to your name, email address,  phone number, address, avatar image, credit card information when you make a purchase through the Site along with any other background information provided or contained in messages you send to us.  We may also collect topics you are interested in and any other information you choose to share.  By browsing our Site or sending us information, you explicitly consent to the Company processing your Personal Information in accordance with this Privacy Notice.  

The Company collects Personal Information from you when you request information from us and/or supply, information through the Site, such as when you fill out a contact form or inquiry, subscribe to a newsletter, use the search feature on the Site, provide comments or any other feedback, fill out a form or enter any other information on the Site to communicate with us. From time to time, we may also collect information that you submit when you participate in any online surveys that we may post on our Site.   Please do not send us any information you do not wish for us to use.  Once you register, you have opted in to receive non-commercial electronic communications from us.  We may also provide you with the opportunity to participate in surveys through the Site.  If you participate, we will request certain Personal Information.  Participation in surveys is completely voluntary and you therefore have a choice whether to disclose such information.  If you use the Site, you agree to receive certain communications from us including but not limited to the following:

Special Offers, Newsletters and Updates.  If you opt-in to receive special offers and newsletters from us, we will occasionally send you information on products, special deals, promotions and newsletters. You can subscribe to or unsubscribe from these emails from us at any time.  When you send an email, your email message along with email address and responses are saved for communication purposes with you. This information is kept confidential and we do not share, sell or trade your email information with third parties except as otherwise stated in this Privacy Notice.

Blogs.  Our Site may have links or access to publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them.

Customer Service.  Based upon the Personal Information you provide us, we will communicate with you in response to your inquiries, to provide the Services you request and to manage your account. We will communicate with you by email or telephone, as you may elect.

Personal Information We Collect

When you access or use the Site, we may automatically collect information about you, including:

Cookies.  In an effort to be transparent with our data collection practice and the technologies we use to provide the Site, the following explains how we use Cookies.  “Cookies” are files with small amounts of data including an anonymous unique identifier that a website sends to your computer’s hard drive when you are viewing the website. Information gathered through Cookies may include the date and time of visits, the pages viewed, and time spent using the Site. If you do not agree to our use of Cookies, you should set your browser settings accordingly or not use the Site. You may remove or block Cookies using the settings in your browser; however, in some cases that may impact your ability to use the Site and/or user experience while using the Site.  We use Cookies and web log files for the following, which may include without limitation: (i) to track usage and trends, (ii) to improve the quality of the Site, (iii) to customize your experience and/or (iv) to compile anonymous, aggregated information that allow us to understand how our Site is used.

Cookies are categorized by how long they are stored and their function.  The Cookies the Company uses are as follows: 

  • Strictly Necessary Cookies:  We use Cookies where they are essential for the operation of our Site, such as to enable you to navigate around the Site and use our Site’s features.
  • Session Cookies:  We use cookies to allow our Site to uniquely identify your browsing session, which allows us to coordinate this information with data from our Site’s server.  
  • Persistent Cookies: Persistent Cookies remain on a visitor’s device for a set period of time specified in the Cookie. They are activated each time that the visitor visits the Site that created that particular Cookie.  For example, when you leave a comment on our Site, you may opt-in to saving your name and email address. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These Cookies will last for one year.
  • Analytics:  We use “analytics” cookies, which, in conjunction with our web server’s log files, allow us to calculate the aggregate number of people visiting our Site and which parts of our Site are most popular. This helps us gather feedback so that we can improve our Site and offer the best user experience.
  • Targeting:  We also use Cookies to record your visit to our Site, the pages you have visited, and the links you have followed. We will use this information to make our advertising more relevant to your interests, and we may also share this information with third parties for this purpose.

How to opt out of interest-based advertising Cookies:  We do not control interest-based advertising cookies on the Services. However, many advertising companies that collect information for interest-based advertising are members of the Digital Advertising Alliance (“DAA”) or the Network Advertising Initiative (“NAI”), both of which maintain websites where people can opt out of interest-based advertising from their members.

Non-Identifiable Data: When you interact with us through the Site, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. We may store such information itself or such information may be included in databases owned and maintained by the Company, affiliates, agents or service providers. The Site may use such information and pool it with other information to track, for example, the total number of visitors to our Site, the number of visitors to each page of our Site, and the domain names of our visitors. It is important to note that no Personal Information is available or used in this process.

Aggregated Personal Information: In an ongoing effort to better understand and serve the users of the Site, we often conducts research on its customer demographics, interests and behavior based on the personal data and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregate data with our affiliates, agents and business partners. This aggregate information does not identify you personally. We may also disclose aggregated user statistics in order to describe our Services to current and prospective business partners, and to other third parties for other lawful purposes.

Google Analytics: We may allow third party service providers to use Cookies or similar technologies to collect information about your browsing activities over time and across different websites following your use of the Site. For example, we use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how users use the Site and enhance your experience when you use the Service. For more information on how Google uses this data, go to www.google.com/policies/privacy/partners/.  We may also from time to time implement Google Adsense along with third party advertising on the Site. Google Analytics features based on Display Advertising (e.g., Remarketing with Google Analytics, Google Display Network Impression Reporting, Google Analytics Demographics and Interest Reporting, and Integrated services that require Google Analytics to collect data via advertising cookies and anonymous identifiers). Visitors can opt out by using Google’s Ads Settings or going to https://tools.google.com/dlpage/gaoptout/.

Other Tracking Technologies: We may supplement information you provide to us with information from other sources, such as information to validate and/or update your address.  This information is used to maintain the accuracy of information on the Site and for internal analysis.  We may also use clear gifs, pixel tags and web beacons, which are tiny graphic images placed on website pages and/or in our emails that allow us to determine whether you have performed specific actions and are further used to track online movements of our users.  In contrast to Cookies, which are stored on your computer’s hard drive, clear gifs are embedded invisibly on web pages.  We do not tie the information gathered by clear gifs to your Personal Information.

Third Party Services:  To support the Site, we may use services hosted by third parties.  These services may collect information sent by a browser as part of a web page request, including ‘Internet Protocol’ addresses, browser software, and/or clickstream patterns. If such third-party services collect information, they do so anonymously without identifying individual visitors.  However, we may link the information we record using tracking technology to Personal Information we collect.  

Device Data: We use device data, which is information concerning a device you use to access, use, and/or interact with the Site, such as operating system type and/or mobile device model, browser type, domain, and other system settings, the language your system uses and the country and time zone of your device, geo-location, unique device identifier and/or other device identifier, mobile phone carrier identification, and device software platform and firmware information.

HOW WE USE INFORMATION COLLECTED

We use Personal Information you provide in a manner that is consistent with this Privacy Notice. If you provide Personal Information for a certain reason, we may use the Personal Information in connection with the reason for which it was provided. For instance, if you contact us by email, we will use the Personal Information you provide to answer your question or resolve your problem. Also, if you provide Personal Information in order to obtain access to the Site, we will use your Personal Information to provide you with access to such services and to monitor your use of such services.   Your Personal Information is used to personalize your experience, improve the Site to better serve you, provide customer service support, efficiently process your requests or transactions, tailor advertisements to you, elicit reviews of Services or products, provide you offers, promotions and to follow up with you through correspondence (email or phone). Each marketing communication we send you will contain instructions permitting you to opt out of receiving future marketing communications. In addition, if at any time you wish not to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us at hello@kirstensimoncoaching.com.  We may use financial information to process payment, enroll you in one of our accounts and/or other related services in which you elect to participate.  Non-personally identifiable information is used to analyze Site statistics related to user behavior and interests, improve our performance and your use of the Site and to further enhance our products and Services offered to you.
If we intend on using any Personal Information in any manner that is not consistent with this Privacy Notice, we will update this Privacy Notice and you will be informed of such anticipated use prior to or at the time at which the Personal Information is collected.

COMMENTS AND SOCIAL MEDIA 

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. When you leave a comment, your name, email address and website/organization name is not shared with a third party, and may be used to communicate with you. 

If you provide a tesimonial to us, we will obtain your written consent before publishing your name next to it on our Website and/or social media sites. The publicly accessible areas of the Website and social media platforms will be available to anyone who is able to access that content.

Social media accounts and sharing options are available on this Site. Social media sites (Facebook, Twitter, YouTube, and so forth) can track your Personal Information. Should you choose to interact with us on social media, please note that you will be voluntarily disclosing that Personal Information. This information will no longer be private. It becomes public information and can be collected and used by others. We have no control over and take no responsibility for the use, storage or dissemination of such publicly disclosed Personal Information by you.  You may also have the option of posting your Site activities to social networking services when you access content through the Site (for example, you may post to Facebook that you performed an activity on the Service); you acknowledge that if you choose to use this feature, your friends, followers and subscribers on any social networking services you have enabled will be able to view such activity.

Any such interactions via comments and social media with us do not subject us to any kind of liability related to misuse of your information by others.  Please remember that the manner in which social networking services use, store and disclose your information is governed by the policies of such third parties, and the Company shall have no liability or responsibility for the privacy practices or other actions of any social networking services that may be enabled within the Site. 

THIRD PARTY LINKS AND USE 

We may include, offers or advertise third party links, products or services on the Site. Once you click on a third party link and leave this Site, you are no longer bound by our Privacy Notice and Terms and Conditions.  Articles on this Site may include embedded content (e.g. videos, images, advertisements, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use Cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

We have no control over these third parties and they have their own privacy policies. Neither are we responsible for the activities and practices of these third parties. You should contact them directly and read their privacy policies for any questions.  If you are using a third-party website and/or service and you allow them to access your personal information, you do so at your own risk.

DISCLOSURE OF YOUR INFORMATION

As a general rule, we do not disclose your Personal Information to third parties with the exception of the following circumstances:

  • Service Providers. We may disclose your information to our trusted third parties that work with us such as our Site’s hosting partners, email marketing service provider, other service providers that assist in the operation of the Site, and any other affiliates and subsidiaries, employees and/or contractors we rely upon to provide you products and Services offered here (“Service Providers”).   Our Service Providers will be given access to your information as is reasonably necessary to provide the Site.  We strive to use commercially acceptable means to protect your Personal Information. If Service Providers acquire confidential or proprietary information belonging to the Company or its customers, such information is required to be handled in confidence and may not be disclosed to unauthorized third parties. Service Providers who violate our security and safe maintenance of data policies are subject to appropriate discipline including, but not limited to, termination.  We will not share your Personal Information in ways unrelated to those described in this Privacy Notice or will otherwise prohibit such unrelated use. Certain Service Providers will automatically collect non-identifying information about your use of the Site by using Cookies and other technologies as similarly used by the Company. 
  • Comply with Laws.  We may disclose your Personal Information in order to comply with state or federal regulations related to copyright infringement lawsuits or any other legal claims related to the Site. The Company may also disclose your Personal Information (i) to investigate and defend the Company members against any third party claims and/or allegations and/or otherwise to protect the Company from liability, (ii) to investigate, prevent and/or take action regarding suspected and/or actual illegal activities, (iii) to assist government enforcement agencies, respond to a legal process and/or comply with the law, (iv) to exercise or protect the rights, property and/or personal safety of the users of the Site and/or (v) to protect the security and/or integrity of the Site.
  • Business Transfers.  We may disclose your information to our successor and/or acquiring party in the event of a merger, acquisition, restructuring, dissolution or partial sale in the future. However, your Personal Information will be transferred to the acquiring party in accordance with this Privacy Notice.
  • For Collaboration. We may share your information, including when you choose to use certain features in the Site that by their nature support sharing with third parties who you choose. Your name, email address, and any content you choose to share will be shared with such third parties, and such third parties may communicate with you in connection with your use of the Site. 

OPT OUT

In compliance with the CAN-SPAM Act, all emails sent from our organization will clearly state who the email is from and provide clear information on how to contact the sender. Should you wish to no longer receive communication from us, you have the option of unsubscribing by clicking “unsubscribe” in the bottom of the email we send to you or by contacting us.

As for third party websites, please contact them directly to unsubscribe and/or opt out from their communications. 

How We Retain Your Personal Information

We will retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. The precise periods for which we keep your Personal Information vary depending on the nature of the information and why we need it. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use and/or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.  

In some circumstances we may anonymize your Personal Information (so that it can no longer be associated with a user) for research or statistical purposes in which case we may use this information indefinitely without further notice.  We may retain information (including without limitation your personally identifiable information) for a commercially reasonable time for backup, archival, audit purposes, and/or to comply with legal obligations, resolve disputes and enforce agreements. In some cases, if you choose not to provide us with requested information, you may not be able to use the Services. You can request further details of retention periods for different aspects of your Personal Information by contacting us. 

Please note that in the course of providing the Services, we collect and maintain aggregated, anonymized, or de-personalized information which we may retain indefinitely.

DATA TRANSFERS

Although the Site is accessible over the Internet and therefore available worldwide, the Site are intended for residents of and businesses in the United States only. If you choose to access the Site from locations outside the United States, such conduct is at your own risk and subject to the laws of the United States, which may differ from privacy laws and regulations in your state or home country, and you are responsible for compliance with any local laws and regulations. Nothing in the Site should be interpreted as a promotion or solicitation for any service of any nature that is not authorized by the laws and regulations of the country where you are located. Personal Information collected through or from using the Site may be stored and processed in the United States or any other country in which the Company or its affiliates, subsidiaries, or agents maintain facilities, and by using the Site you consent to any such transfer of information outside of your country. Users from outside the United States should not use or access the Site or disclose any information, including Personal Information, through the Site. Individuals outside the United States who disclose any data through the Site, including Personal Information, hereby acknowledge and consent to such data being stored in the United States or any other country, and transferred outside your country.

Online Tracking.  We do not currently recognize automated browser signals regarding tracking mechanisms, which may include ‘Do Not Track’ instructions.

Other Jurisdictions

Personal Information that you submit through the Services may be transferred outside of the jurisdiction in which you live.  We also store Personal Information locally on the devices you use to access the Services. Your Personal Information may be transferred to other jurisdictions that do not have the same data protection laws as the jurisdiction in which you initially provided the information. The following provisions may apply to you depending on where you are located.

Nevada.  

This notice is provided to you pursuant to state law. PRIVACY POLICY UPDATES 

The Site will be updated and modified as needed, with or without advance notice, so please review it periodically. We will update the ‘Last Updated’ date above and may provide you additional forms of notice of modifications and/or updates as appropriate under the circumstances.  You can determine when this Privacy Notice was last revised by referring to the date it was “Last Updated” above.  If you disagree with any changes to this Privacy Notice and do not wish your information to be subject to the revised Privacy Notice, you will need to stop using the Site. Any modifications to this Privacy Notice will be effective upon our publishing of the new terms, and your continued use of our Site after the posting of any updates constitutes your acceptance of our modified Privacy Notice.  Your continued use of the Site after any modification to this Privacy Notice will constitute your acceptance of such modifications and/or updates.

The governing language of this Privacy Notice is English, which shall prevail over any other languages used in any translated document.
